1. About These Terms

These Terms & Conditions (“Terms”) apply to your access to and participation in products, services, programs and resources provided by The One Day Project (“we”, “us”, “our”).

By purchasing, registering for or expressly accepting these Terms in connection with a Program, you agree to these Terms.

Please read them before purchasing or registering.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including rights available under the Australian Consumer Law.

1. Definitions

For these Terms:

“Program” means any paid or free coaching program, mentoring service, course, membership, masterclass, workshop, challenge, digital product, community, event or other service or resource provided by The One Day Project.

“Program Details” means the specific information provided in connection with a Program, including where applicable its price, duration, dates, inclusions, live sessions, access periods, support, payment arrangements and other relevant details. Program Details may be communicated through a sales page, checkout page, registration page, offer page or written enrolment communication.

“Program Fee” means the price, if any, specified in the applicable Program Details.

“Program Period” means the duration or access period specified in the applicable Program Details.

“Included Support” means the coaching, community access or other support expressly stated as included in the applicable Program Details.

The Program Details applicable when you purchase or register form part of your agreement with us.

Where a Program is free, provisions relating to fees, payment plans and refunds do not apply.

1. Our Products and Services

The One Day Project provides coaching, mentoring, education and resources designed to support personal and business growth, implementation and development.

Depending on the Program, this may include:

* individual or group coaching and mentoring;

* business strategy, planning and implementation support;

* marketing, sales and business-growth education;

* personal development, mindset and self-concept coaching;

* live coaching sessions, workshops and masterclasses;

* memberships and online communities;

* recorded or self-paced courses and trainings;

* worksheets, templates, exercises and downloadable resources; and

* other educational content and support described in the applicable Program Details.

You receive only the products, services, access and support expressly included in the Program you purchase or register for.

1. Nature and Scope of Coaching

Our Programs provide education, coaching, mentoring, guidance, accountability and implementation support.

Coaching is a collaborative process. We may provide questions, perspectives, frameworks, strategies, suggestions and educational information, but you remain responsible for your own decisions, actions and implementation.

Our Programs are not a substitute for advice from appropriately qualified professionals.

Nothing provided through our website, Programs, coaching, communities or materials constitutes legal, financial, investment, accounting, taxation, medical, psychological or mental-health advice.

Where appropriate, you should seek advice from a suitably qualified professional.

1. No Guarantee of Results

We do not guarantee any particular personal, business or financial result from participating in a Program.

In particular, we do not guarantee any specific:

* income or revenue;

* profit;

* number of clients;

* sales;

* business growth;

* financial outcome; or

* personal transformation or result.

Any goals, examples, case studies, testimonials or client stories are provided for context and illustrate individual experiences. They are not promises or guarantees of what you will achieve.

Your results depend on many factors outside our control, including your circumstances, decisions, actions, implementation, consistency and other factors specific to you and your business.

1. Your Responsibility

You remain responsible for your own personal and business decisions at all times.

You are responsible for deciding whether and how to implement any coaching, information, strategy or suggestion provided through a Program.

You are also responsible for:

* participating in the Program in a manner appropriate to your circumstances;

* completing any actions or implementation you choose to undertake;

* seeking qualified professional advice where required;

* providing accurate information where relevant;

* attending or accessing Program components during applicable access periods; and

* asking for clarification where needed.

You retain responsibility for your business, finances, actions, decisions and outcomes.

1. Program Information and Changes

The specific inclusions, duration, dates, access periods and support for each Program are set out in the applicable Program Details.

We may make reasonable changes to the timing, format, delivery platform or administration of a Program where necessary.

Where a material change affects a live Program, we will provide reasonable notice where practicable.

Nothing in this clause limits any rights you may have under applicable law where a material change means a service is not supplied as agreed.

1. Live Sessions and Attendance

Where a Program includes live sessions, session details will be communicated as part of the Program Details or during the Program.

You are responsible for attending scheduled sessions.

If you cannot attend a live session, a replay may be provided where replay access is included in that Program.

Missing a live session does not ordinarily entitle you to a refund, replacement session, individual make-up session or extension of the Program.

If we need to reschedule a session due to illness, emergency or another unforeseen circumstance, we will provide reasonable notice where possible and make reasonable alternative arrangements.

1. Recordings and Replays

Where a live Program session is recorded, participants will be informed.

A recording may capture participants’ names, images, voices, chat contributions and information voluntarily shared during the session.

Recordings may be made available to authorised participants in the relevant Program for the replay period specified in the Program Details.

Replay access expires at the end of the stated access period.

Unless we obtain separate permission, participation in a recorded session does not give The One Day Project permission to use your image, voice, personal story or coaching contributions publicly for advertising, testimonials or promotional purposes.

You must not record, copy, download, reproduce, distribute or provide Program recordings to another person unless we expressly permit you to do so.

1. Group Coaching and Confidentiality

Where a Program involves group coaching or a community, you agree to respect the privacy and confidentiality of other participants.

You must not share another participant’s personal information, business information, circumstances, experiences, coaching contributions or other confidential information outside the Program without their permission.

You should only share information that you are comfortable sharing in a group environment.

We establish and communicate confidentiality expectations to participants; however, because group Programs involve independent third parties, we cannot guarantee the conduct or confidentiality of every participant.

1. Community and Included Support

Where a Program includes access to a community, group or between-session support, the nature and duration of that support will be determined by the applicable Program Details.

Community spaces may be used for coaching-related discussion, questions, implementation, accountability, support and sharing progress.

Unless expressly included in the Program Details:

* community access does not provide unlimited individual coaching;

* private messaging with us is not included;

* immediate responses are not guaranteed; and

* community spaces are not continuously monitored.

Access to a Program community may expire at the end of the applicable Program Period or other access period communicated to you.

1. Community Conduct

You agree to interact respectfully with us and other participants.

You must not engage in conduct that is abusive, threatening, discriminatory, harassing, deliberately disruptive or materially harmful to another participant.

You must not use a Program or community to spam, solicit or promote unrelated products or services to other participants without permission.

We may take reasonable steps to protect participants and the integrity of the Program, including issuing a warning, restricting community access or, where reasonably necessary, removing a participant for serious or repeated breaches of these Terms.

Any decision relating to fees, refunds or outstanding payments remains subject to these Terms and applicable law.

1. Pricing and Payment

Where a Program requires payment, the Program Fee and payment arrangements will be provided before or at purchase.

Unless otherwise stated, prices are displayed in Australian Dollars (AUD).

Payment must be made in accordance with the payment arrangement selected or agreed at purchase.

Access may be withheld or suspended where a payment is overdue, subject to applicable law and any arrangements agreed with us.

1. Payment Plans

Where a payment plan is offered, it is an instalment arrangement for payment of the total Program Fee and does not make the Program a pay-as-you-go service unless expressly stated otherwise.

By selecting a payment plan, you agree to make the scheduled payments communicated at purchase.

Subject to applicable law, choosing to withdraw, ceasing participation or failing to attend does not automatically cancel outstanding instalments.

If you experience a genuine payment issue, please contact us promptly.

1. Change of Mind, Withdrawal and Refunds

Please make a considered purchasing decision and review the applicable Program Details before purchasing.

Unless otherwise stated for a particular Program, refunds are not provided simply because you change your mind.

For live coaching Programs, your place may be reserved and capacity allocated to you when you enrol.

You may choose to withdraw from a Program. However, withdrawal does not itself entitle you to a refund or automatically release you from outstanding payment obligations.

Different refund or cancellation arrangements may be expressly offered for a particular Program. Where they are, those specific arrangements will form part of the applicable Program Details.

Nothing in these Terms or our Refund Policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights available under the Australian Consumer Law.

1. Digital Products and Access

Where a Program includes digital products, courses, recordings, downloads or other online materials, access will be provided for the period stated in the applicable Program Details.

Unless otherwise expressly stated, your access is personal and non-transferable.

You must not share login details or provide unauthorised third parties with access to paid Program materials.

Technical access issues should be reported to us so we can take reasonable steps to resolve them.

1. Intellectual Property

Unless otherwise stated, all Program content and materials provided by The One Day Project remain our intellectual property or are used by us with permission.

This includes, without limitation:

* coaching frameworks and methodologies;

* videos and recordings;

* presentations;

* written content;

* worksheets and exercises;

* templates;

* downloads;

* graphics; and

* educational materials.

Your purchase or registration gives you a personal, non-exclusive, non-transferable licence to access and use the materials for your own personal or business implementation, subject to the applicable Program Details.

You must not reproduce, distribute, publish, sell, sublicense, teach, commercially exploit or provide our materials to another person without our written permission.

Nothing in this clause prevents you from applying the knowledge, concepts or skills you learn to your own life or business.

1. Third-Party Platforms

Programs may be delivered using third-party services such as video-conferencing software, community platforms, email providers, course-hosting platforms and payment processors.

We take reasonable steps to use appropriate providers but cannot guarantee that third-party services will operate uninterrupted or without technical issues.

Where a third-party issue materially affects delivery of something we have agreed to provide, we will take reasonable steps to restore access or provide a reasonable alternative where appropriate.

Your use of third-party platforms may also be subject to those providers’ own terms and privacy practices.

1. Privacy

We handle personal information in accordance with our Privacy Policy.

Where coaching or community participation involves sharing personal or business information, you should only provide information you are comfortable sharing in the relevant environment.

Where live sessions are recorded, personal information contained in those recordings will be handled in accordance with our Privacy Policy and these Terms.

1. Communications and Marketing

We may send you communications necessary to administer or deliver a Program you have purchased or registered for, including access information, reminders, schedule updates and support communications.

Where permitted and where you have consented or otherwise opted in, we may also send educational or marketing communications.

You may unsubscribe from marketing emails using the unsubscribe link provided. Unsubscribing from marketing does not necessarily prevent us from sending communications reasonably necessary to deliver a Program you have purchased or registered for.

1. Limitation of Liability

To the extent permitted by law, The One Day Project is not responsible for indirect or consequential loss arising from decisions or actions you independently take following participation in a Program.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.

Where applicable law permits liability to be limited, any limitation will apply only to the extent permitted by that law.

1. Suspension or Termination

You may cease participating in a Program at any time, subject to the applicable payment, withdrawal and refund provisions.

We may suspend or terminate access where reasonably necessary because of serious or repeated breaches of these Terms, including harassment, abuse, material confidentiality breaches, misuse of intellectual property, non-payment or conduct that materially disrupts the Program or affects other participants.

Where access is suspended or terminated, any entitlement to a refund, continuation of payment obligations or other remedy will be determined in accordance with these Terms, the applicable Program Details and applicable law.

1. Relationship With Other Policies

Our Privacy Policy, Refund Policy and Disclaimer should be read alongside these Terms.

The Program Details applicable to the Program you purchase or register for also form part of your agreement with us.

If specific Program Details expressly differ from these general Terms, the specific Program Details will apply to that Program to the extent of the inconsistency, subject to applicable law.

We may update these Terms from time to time.

The version applicable to a purchase or registration will generally be the version presented or made available to you when you enter into that transaction, unless a change is required by law or is otherwise validly agreed.

Updating these Terms on our website does not retrospectively remove rights or materially alter an existing agreement simply because a newer version has been published.

These Terms are governed by the laws of Victoria, Australia.

Nothing in this clause limits any rights you may have to bring a claim or exercise a remedy in another jurisdiction where applicable law provides that right.
